Land Subdivision in Thailand.

How land subdivision in Thailand works at the Land Office: the survey, the new title deeds, the costs, and the checks a lawyer runs before a plot is split.

Key facts

What is land subdivision?
Splitting one title deed into two or more at the Land Office. A government surveyor measures the new boundaries and the office issues a separate deed for each new plot.
How long does it take?
The official standard for the procedure is 3 months, plus a survey queue that varies by office from 15 to 200 days. Planning the split and clearing the title happen before that clock starts.
Do I need a lawyer to subdivide?
Not by law. A lawyer checks the title and encumbrances, plans access for each new plot, registers servitudes, and confirms whether selling the plots triggers the land allocation rules.

What land subdivision in Thailand involves

Land subdivision in Thailand means splitting one title deed into two or more. The owner applies at the Land Office for the district where the land sits, a government surveyor measures the new boundaries on the ground, and the office issues a separate deed for each new plot. The official service manual for boundary, subdivision and consolidation surveys sets out the procedure and lists a standard processing time of 3 months, on top of a survey queue that varies by office.

Most people who subdivide are landowners, not buyers: a family allocating land among relatives, an owner selling off part of a plot, or a small developer preparing a project. The mechanics are administrative, but the decisions behind them are legal. What title the land carries, what is registered against it, and whether each new plot will have lawful access decide whether the split creates clean, sellable deeds or a problem that surfaces at the next transfer. That is the work a lawyer does before the survey is booked, and where comparing firms pays off.

What a lawyer checks before splitting a plot

  • The title type

A full title deed (Chanote) subdivides cleanly. Lesser documents, such as a Nor Sor 3 Kor, follow the same survey procedure but carry weaker boundary evidence, so the check matters more.

  • Encumbrances on the deed

A mortgage, registered lease, or servitude over the original plot does not disappear when the land is split. How it attaches to the new plots is resolved before the application, not after.

  • Access for every new plot

A plot with no road frontage and no registered right of way is hard to sell and hard to build on. The split is planned so each new deed has lawful access.

  • Servitudes to be registered with the split

Where an inner plot will depend on a driveway or utility line over another, the right can be registered on the deeds at the Land Office so it binds future owners.

  • Exposure to the land allocation rules

Subdividing to sell many plots can trigger the licensing regime under the Land Allocation Act B.E. 2543, which adds requirements an ordinary subdivision does not have. A lawyer confirms whether the rules apply to the plan before any plot is offered for sale.

Note: Access rights are the check that saves the new plots

The Land Office will register a subdivision that leaves an inner plot landlocked. Nothing in the survey step forces every new plot to touch a road. If a plot you plan to keep or sell will only be reachable across its neighbour, the practical fix is to register the access as a servitude on the deeds when the split is registered, while all the plots still belong to you. Fixing it later means negotiating with whoever owns the land in between.

How the subdivision process runs

The procedure itself is standardized: one application, one survey, new deeds. The steps below follow the official service manual; the calendar time is dominated by the survey queue at the local office, which the manual puts at anywhere from 15 to 200 days depending on workload.

From one deed to several

  1. Title review and planning the split

The deed, encumbrances, access, and any allocation-rule exposure are checked, and the boundaries of the new plots are decided. This is the stage where a lawyer earns the fee: everything after it is execution.

  2. Application at the Land Office

The owner, or a lawyer holding a registered power of attorney, files the subdivision application with the original deed at the Land Office for the district where the land sits, and pays the application fees.

  3. The survey on the groundQueue varies by office

A government surveyor measures the new boundaries with the owner present and neighbouring owners invited to confirm the lines. Survey fees depend on the land and the number of new plots.

  4. Registry review and neighbour notice

The office reviews the survey result and notifies adjoining owners. Objections are resolved before the split is approved.

  5. New deeds issued3 months official standard

The office registers the subdivision and issues a separate title deed for each new plot. The official standard for the whole procedure is 3 months, excluding the survey queue.

  6. Registering access and servitudes where needed

Rights of way, utility easements, and any agreed conditions between the new plots are registered on the deeds so they bind future owners.

What subdivision costs, and what comes next

The Land Office side is modest: application fees of a few baht to a few dozen baht per plot under the official schedule, plus survey fees that depend on the land and the number of new plots. There is no percentage tax on the split itself, because no ownership changes hands. The cost that does scale is the next transaction: when a subdivided plot is sold, the transfer registers at the standard rates in the Department of Lands fee schedule, starting with the 2% transfer registration fee on the appraised value. How a purchase runs from the buyer's side is covered in our property purchase page and the guide to buying property.

Professional fees vary by firm and by scope: reviewing one clean Chanote is a different job from restructuring a family plot with a mortgage, an inner parcel, and a sale planned for next year. If you are on the buying side of a freshly subdivided plot, the same questions run in reverse, and due diligence on the title is where they get answered.

A property lawyer can review the deed, plan the split, coordinate the survey, file the applications, and register the access rights that keep every new plot usable. Common questions

Frequently asked questions

How does land subdivision work in Thailand?
The owner applies at the Land Office for the district where the land sits, a government surveyor measures the new boundaries with neighbouring owners invited to confirm the lines, the office reviews the result, and a separate title deed is issued for each new plot. The official service manual lists a standard processing time of 3 months for the procedure, on top of a survey queue that varies by office.
Can any land title be subdivided?
A full title deed (Chanote) is the clean case, and the same official survey procedure also covers Nor Sor 3 Kor certificates. Weaker possession documents carry weaker boundary evidence, so what the land actually holds is the first thing checked. Encumbrances such as a mortgage or registered lease do not block a split by themselves, but how they attach to the new plots has to be resolved with the lender or lessee before the application.
What happens if a subdivided plot has no road access?
The Land Office does not require every new plot to touch a road, so a subdivision can lawfully create a landlocked parcel. The practical protection is to register a right of way as a servitude on the deeds at the time of the split, while all the plots still belong to one owner. A landlocked plot without registered access is hard to sell, hard to finance, and depends on the goodwill of whoever owns the land in between.
Do I need a licence to sell subdivided plots in Thailand?
Selling one or two plots split from your own land is normally an ordinary transfer. Offering many subdivided plots for sale can bring the project under the Land Allocation Act B.E. 2543, which imposes a licensing regime with its own requirements. Whether a specific plan crosses that line depends on the numbers and structure of the sales, so a lawyer confirms it before any plot is marketed.
