Domestic Violence & Protection Orders in Thailand.

The law, and what it is for

Domestic violence in Thailand is governed by the Domestic Violence Victim Protection Act B.E. 2550 (2007). Its purpose is protective rather than purely punitive: it exists to stop violence recurring and to secure the welfare of the person affected, alongside the ordinary criminal law.

That distinction matters practically. A domestic violence matter can run alongside a criminal complaint, a divorce, and a child custody question at the same time, and the decisions taken in one affect the others. Handling them as separate problems, with separate advisers, is how people end up with inconsistent accounts on the record.

The framework is also being strengthened. On 18 March 2025 the Cabinet approved a draft bill amending the 2007 Act, broadening the definition of domestic violence to cover sexual harassment and acts intended to cause physical, mental and health-related harm as well as damage to reputation, and raising the penalty to up to six months' imprisonment or a fine of up to 60,000 baht, from a previous 6,000 baht, or both, with penalties up to 50 percent higher for repeat offences within three years or offences against minors under 18. As a draft approved by Cabinet, the position at the time you read this is worth confirming with a lawyer rather than assumed.

What a lawyer does in these cases

The first job is the record. What was reported, when, to whom, and what evidence exists. Medical records, photographs, messages and witness accounts are what later decisions rest on, and they are far easier to secure early than to reconstruct.

The second is protection. The Act is built around protective measures for the person affected, and the practical question a lawyer answers is which are available in the specific situation and how quickly they can be sought.

The third is coordination, which is the part most often done badly. A domestic violence matter frequently sits alongside a divorce, a custody dispute, and sometimes an immigration question where one party's right to remain depends on the relationship. Those cannot be run in isolation from each other. What is said in one becomes evidence in the others.

The fourth is realistic expectation-setting. Outcomes in these cases depend on evidence, on the other party's conduct, and on decisions that belong to police, prosecutors and courts. A firm that promises a result is not describing how this works.

For foreign spouses in particular

There is an additional layer that Thai nationals do not face. Where a foreign spouse's right to remain in Thailand is connected to the marriage, ending the relationship raises an immigration question at the same moment as everything else. That is not a reason to stay, but it is a reason to get advice from someone who can see both problems at once rather than dealing with them sequentially and discovering the conflict later.

Documents are a second practical issue. Passports, marriage certificates and identification are sometimes withheld, and replacing them is its own process. A lawyer can advise on that alongside the rest.

On fees, firms set their own and protection work is hard to scope in advance, so it is usually billed hourly rather than as a fixed fee. Some firms take this work at reduced rates, and legal aid and support organisations exist alongside private firms. Ask directly what a firm charges and what it covers, and say if cost is a constraint: it changes what is worth doing first.
