Who can adopt a child in Thailand?
For a child under the Department of Children and Youth, an applicant at least 25 years old and at least 15 years older than the child, qualified to adopt under the law of their country of domicile, which must have diplomatic relations with Thailand.

Adoption in Thailand is a vetted process, not a transaction

The first thing to understand is that adoption here runs through a committee. For a child under the care of the Department of Children and Youth, applicants are assessed against published criteria before any child is matched, and the committee reviews cases where an applicant's circumstances raise a question.

The second is that the legal step at the end, registration, is only the visible part. Most of the process is assessment: of the applicant, of the applicant's household, and of the child's history.

The third is that domestic and intercountry adoption are different tracks with different rules. Thailand is a member of the Hague Conference on Private International Law, whose conventions cover cross-border child adoption, and an intercountry adoption is expected to work in both countries rather than only in one.

Alongside the formal criteria, applicants are assessed on published social qualifications: good physical health, stable employment and a good income, no more than two biological or adopted children already in the family, no history of criminal activity, no history of mental illness, a positive attitude towards child-rearing, and a plan for raising a child. These are assessment factors rather than box-ticking, which is why the preparation of an application matters.

Where a lawyer actually helps

Not with the matching, which is the committee's function, and not with the assessment, which is a social work exercise. A firm that suggests otherwise is misdescribing the process.

Where legal help earns its fee is in the documents and the cross-border fit. An intercountry application involves records from two jurisdictions, each of which has to be acceptable to the other, and that means legalisation, certified translation, and consistency between what is filed here and what is filed at home.

The second area is the legal effect. Adoption changes the child's position on inheritance and their relationship to the adoptive family, and where the family has assets in more than one country those consequences are worth mapping before rather than after.

The third is registration itself. The Family Registration Act provides that the applicants for registration of a child adoption are the adoptive parent and the adopted child. There is also a route out: termination of an adoption by agreement is registered where both parties request it, and where a court revokes or terminates an adoption, the judgment is recorded in the same way as other family court judgments, on a certified correct copy of the final judgment.

Step-parent adoptions, which are common where a foreign spouse wants to adopt a Thai partner's child, sit close to legitimation and to the marriage registration that preceded them, and the right route depends on the family's actual position.

How an adoption is usually approached

  1. Establish which track applies

    Domestic, intercountry, or a step-parent adoption within an existing family. They have different requirements and different agencies involved.

  2. Check eligibility honestly and early

    Age, age gap, length of marriage, existing children, and qualification under the law of your own country of domicile. It is far better to find a problem now than after an application is filed.

  3. Complete preparation and assessment

    Including the required adoptive-parent training through a government agency or child welfare organisation, and the home assessment.

  4. Assemble the documents both countries will accept

    Legalised and translated as required. This is the part that most often stalls, and it is the part a lawyer can genuinely accelerate.

  5. Registration

    The adoptive parent and the adopted child are the applicants for registration of the adoption at the district office.

  6. Deal with the consequences

    Nationality, immigration status, inheritance and estate documents in both countries. None of these update themselves.

Being honest about the timeline

No reliable public figure exists for how long a Thai adoption takes, and this page will not invent one. What can be said is that the length is driven by assessment and matching rather than by paperwork speed, and that the availability of a child suited to a particular family is a variable no applicant or firm controls.

Anyone quoting you a confident timeline should be asked what it is based on. Anyone offering to speed up matching should be treated with considerable suspicion, because that is the part of the process specifically designed not to be influenced.

How is an adoption registered in Thailand?

As with other family registrations, the application is in writing in the prescribed form and is signed before the registrar with witnesses. The Act also provides for the reverse: termination of an adoption by agreement is registered where both parties request it, and where a court revokes or terminates an adoption, the judgment is recorded on submission of a certified correct copy of the final judgment.
Does adoption affect the child's inheritance rights?
Adoption changes the child's legal relationship to the adoptive family, and that has consequences for inheritance. Where a family has assets in more than one country, those consequences need to be mapped in each of them rather than assumed to follow automatically, since recognition of the adoption and its effect on succession are separate questions from the adoption itself. A lawyer can review estate documents in light of the adoption, which is a step families frequently overlook once the process is complete.
