The contract sits on top of a statutory floor

A Thai employment contract does not operate on a blank page. The Labour Protection Act sets minimum standards that apply whatever the document says, and a clause that drops below them does not become valid because both sides signed it.

That floor covers the basics: normal working time not exceeding eight hours a day, overtime on a working day at not less than one and a half times the hourly wage rate, overtime on a holiday at not less than three times, and annual holidays of not less than six working days after a year of service.

So the useful question when reviewing a contract is not whether it looks reasonable, but where it sits relative to the statutory minimum and what it adds above it. Terms that improve on the floor are enforceable; terms that undercut it are not.

What the contract decides, and what the law decides

Statutory minimums come from the Labour Protection Act B.E. 2541 and apply regardless of contract wording. Contracts can improve on them.

The clauses that cause trouble later

Probation is the first. Because a probationary contract is treated as an indefinite contract, calling a period probation does not switch off notice, and once someone passes 120 days of service the statutory severance schedule starts to apply. Contracts that assume probation means free dismissal create the dispute they were meant to avoid.

Fixed-term wording is the second. Genuine fixed-term employment escapes severance only in a narrow case: a specific project outside the employer's normal trade, with a definite start and end. Labelling ordinary rolling work as fixed-term does not meet that test, and the entitlement survives.

The third is what counts as wages. Allowances, commissions, and bonuses are where severance and overtime calculations are won and lost later, so it pays to define them clearly at the start rather than argue about them at the exit.

For foreign employees, the contract also has to line up with the work permit and visa position, since the permitted role and employer are tied together. That coordination usually runs alongside immigration law advice, and the employment side sits under employment and labor law.

Does an employment contract in Thailand have to be in writing?
Employment relationships can exist without a written contract, and the Labour Protection Act's minimum standards apply either way. That said, the absence of a written contract does not help either side when a dispute arrives, because the terms then have to be reconstructed from payslips, messages, and practice. A written contract that defines wages, hours, role, and exit terms is the cheapest form of dispute prevention available.
How does probation work in Thailand?
Probation is a commercial arrangement rather than a separate legal status. The Act deems a probationary contract to be an indefinite period contract, so the normal notice requirement applies during probation, and once the employee has completed 120 days of uninterrupted service the statutory severance schedule applies as well. Dismissing shortly before that threshold, on the assumption that probation removes the obligation, is a common source of claims.
Can I hire someone on a fixed-term contract to avoid severance?
Only in a narrow situation. Severance does not apply to employment for a definite period where the work is a specific project outside the employer's normal business or trade, with a definite date to start and end, or work that is occasional with a definite end. Rolling annual contracts for ordinary work do not meet that definition, and severance remains payable when the relationship ends.
What should a foreign employee check in a Thai contract?
Beyond the usual terms, check that the role, employer, and work location match what the work permit will authorise, since permitted work is tied to the specific employer and position. Also look closely at how wages are defined, because allowances and commissions affect later severance and overtime calculations, and at any clause about repatriation or costs on termination. A lawyer reviewing the contract alongside the immigration position can catch mismatches before they become permit problems.
