A termination in Thailand raises two questions that people tend to merge. The first is whether statutory entitlements were paid: severance under the schedule, plus notice or payment in lieu. The second is whether the dismissal itself was fair, which is a distinct claim with its own remedies.
They come apart in practice. An employer can dismiss lawfully and still owe full severance, and an employer can pay every baht owed and still face an unfair termination claim. Knowing which question you are asking decides what evidence matters and where the claim is filed.
The entitlement question is the more mechanical of the two. The Labour Protection Act removes severance only on specific grounds: dishonesty in duties or an intentional criminal offence against the employer, wilfully causing damage, negligence causing serious damage, or breaching lawful work rules after a written warning, with serious cases needing no warning.

Where an employer relies on breach of work rules, the Act generally requires a written warning first, and the dismissal must follow a rule that was itself lawful and just. Employers who dismiss on a verbal warning, on a rule never communicated, or long after the incident often find the ground does not hold. That does not necessarily make the dismissal reversible, but it usually restores the severance entitlement.

Documents, mostly, and the ones created before the dispute started. The employment contract and work rules, the warning letters and their dates, performance records, the termination letter and the reason it states, and the payments actually made. A reason invented after the fact rarely survives contact with a paper trail that says something different at the time.
Timing matters too. Claims run to deadlines, and evidence held only by the employer becomes harder to obtain the longer someone waits, so the first conversation with a lawyer is better had early than after a settlement has been signed. Employees are often asked to sign a release in exchange for a final payment, and signing before knowing what the statutory floor was is the most common avoidable mistake.
Claims are heard in the labour court, which is a specialised court for employment matters rather than part of the ordinary civil track. Firms handling these cases sit under employment and labor law.
For employers, the same analysis runs before the decision rather than after it: confirm the ground, follow the warning process, give the required notice, and calculate the payment correctly. That sequence is far cheaper than defending it later.
