Can I still get severance if I was dismissed for a reason?
Usually yes. Severance is removed only on the specific Section 119 grounds such as dishonesty, an intentional criminal offence against the employer, wilful or seriously negligent damage, or breach of work rules after a written warning.

Two separate questions after a dismissal

A termination in Thailand raises two questions that people tend to merge. The first is whether statutory entitlements were paid: severance under the schedule, plus notice or payment in lieu. The second is whether the dismissal itself was fair, which is a distinct claim with its own remedies.

They come apart in practice. An employer can dismiss lawfully and still owe full severance, and an employer can pay every baht owed and still face an unfair termination claim. Knowing which question you are asking decides what evidence matters and where the claim is filed.

The entitlement question is the more mechanical of the two. The Labour Protection Act removes severance only on specific grounds: dishonesty in duties or an intentional criminal offence against the employer, wilfully causing damage, negligence causing serious damage, or breaching lawful work rules after a written warning, with serious cases needing no warning.

Where an employer relies on breach of work rules, the Act generally requires a written warning first, and the dismissal must follow a rule that was itself lawful and just. Employers who dismiss on a verbal warning, on a rule never communicated, or long after the incident often find the ground does not hold. That does not necessarily make the dismissal reversible, but it usually restores the severance entitlement.

A reason invented after the fact rarely survives contact with a paper trail that says something different at the time.

Timing matters too. What counts as wrongful termination in Thailand?
In practice the phrase covers two different complaints. One is that statutory entitlements were not paid, where the question is whether the employer had a lawful ground under Section 119 of the Labour Protection Act to withhold severance. The other is that the dismissal itself was unfair, which is assessed on whether there was a sufficient reason for ending the employment. A case can succeed on one and fail on the other, so a lawyer separates them at the outset.
Can I be dismissed during a probation period?
Probation does not create a separate category under the Labour Protection Act, which treats a probationary contract as an indefinite period contract. That means the ordinary notice rules apply, and once someone has completed 120 days of service the statutory severance schedule begins to apply as well. Dismissal shortly before that mark is one of the situations worth having reviewed.
Should I sign a release to get my final payment?
Not before knowing what you are legally owed. Employers commonly offer a final sum in exchange for signing away further claims, and the offer can be below the statutory floor that severance and notice would produce. Having the correct figure calculated first turns the conversation into an informed decision, and a lawyer can review the wording of the release itself, which sometimes covers more than the person signing expects.
How long do I have to bring a claim?
Deadlines apply and they differ depending on what is being claimed, so the safe approach is to take advice quickly rather than to assume there is time. Delay also weakens the practical position: much of the decisive evidence sits with the employer, and records become harder to obtain as time passes.
