Choosing an intellectual property lawyer in Bangkok

An intellectual property lawyer in Bangkok can do three quite different jobs: register rights, advise on how they are owned and used, and enforce them when someone copies. Most firms listed here are full-service practices where IP sits beside corporate, property and dispute work, and at least one is a dedicated IP firm. Both models can suit a client. What matters is whether the firm lists the specific work you need.

The profiles are not interchangeable. Copyright and licensing appear on most of them, trademark filing on fewer, and patent work and IP disputes on fewer still. One firm lists the practice area without naming individual services, so ask it directly. Open each profile to see the services a firm reports before you contact it.

Each card shows the languages a firm works in and whether the first consultation is free or paid, where the firm has listed it. Every firm here works in English and Thai, and several add Chinese, German, French or Japanese, which matters if your brand or invention documents are in one of those languages. For how trademarks, patents and copyright are protected across the country, see the Thailand-wide guide to IP protection.

Registration, advisory and enforcement work

Registration is filing work with the Department of Intellectual Property. For a brand, that means search, filing and replies to the registrar; the Bangkok trademark registration page covers the documents and deadlines. For an invention, it means drafting claims and prosecuting the application; see patent lawyers in Bangkok. Copyright needs no registration, but an owner can file a voluntary notification with the Department, and the DIP's notification procedure lets an attorney-in-fact file it on the owner's behalf.

Advisory work is mostly contracts. It covers who owns what a team or contractor creates, licensing agreements that let others use a brand or technology, and the confidentiality measures behind trade secret protection. It is often where a business needs IP help first, before any filing.

Enforcement starts when a right is copied: evidence, a demand letter, negotiation and, if needed, a case. Check that a firm's profile lists IP disputes before you contact it about a case. Ask whether the same team that handles your filings would also appear in court.

Where Bangkok IP matters are handled

Three offices do most of the work. The Department of Intellectual Property sits just outside the city in Nonthaburi, and filings reach it electronically or through an agent, so few clients ever visit.

Disputes go to the Central Intellectual Property and International Trade Court on Chaeng Watthana Road in Lak Si. Its published jurisdiction covers civil and criminal trademark, copyright and patent cases, disputes over technology transfer and licensing agreements, and trade secret cases. Because no regional IP courts have been set up, it currently hears these cases from across the country.

The third office is the Customs Department's IPR Coordination Center in Khlong Toei. Trademark and copyright owners can record their rights in the Customs trademark and copyright database, known as TCIRs, to request Customs protection for those rights. If copies of your products are being imported, ask whether a firm handles Customs recordation as part of its enforcement work.

Preparing for a first IP consultation in Bangkok

What to bring depends on the work:

  • For a brand: the mark as used, the goods or services it covers, and any earlier filings in other countries.
  • For an invention: a description with drawings, and the dates of any public disclosure or sale.
  • For copyright or licensing: the work itself, the contracts with the people who created it, and any licence already granted.
  • For a dispute: evidence of the copying, where and when you found it, and any correspondence with the other side.
  • For any matter: the owner's company documents, because the owner, not the person who created the work, is usually the one who files or sues.

Questions worth asking before you engage a firm:

  1. Which of registration, advisory and enforcement work does the firm do itself, and which does it refer out?
  2. Who handles the file day to day, and who signs as agent with the Department of Intellectual Property?
  3. Is the fee fixed per stage or hourly, and are official fees and translation billed separately?
  4. In which language will you receive advice, drafts and reports?

This page is general information, not legal advice. For a specific brand, invention or dispute, speak with a qualified professional.

Common questions

Frequently asked questions

How do I choose an intellectual property lawyer in Bangkok?
Start with the work you need: registration, advice on ownership and licensing, or enforcement against copying. The Bangkok firms listed on Justenda do not all offer the same services, so check which ones each profile lists, then compare languages, first consultation terms and whether the same team handles both filings and court work.
What is the difference between IP registration, advisory and enforcement work?
Registration is filing with the Department of Intellectual Property, such as trademark and patent applications. Advisory work is mostly contracts: who owns what employees and contractors create, licensing, and keeping trade secrets confidential. Enforcement starts when a right is copied and runs from evidence and demand letters to a case at the IP court.
Which court hears intellectual property cases in Bangkok?
The Central Intellectual Property and International Trade Court, in the Government Complex on Chaeng Watthana Road, Lak Si. It hears civil and criminal cases on trademarks, copyright and patents, as well as licensing and trade secret disputes. Because no regional IP courts have been established, its jurisdiction currently covers the whole country.
Can a Bangkok firm file a copyright notification for me?
Yes. Copyright in Thailand does not depend on registration, but the Department of Intellectual Property accepts a voluntary copyright notification, and its procedure allows an attorney-in-fact to file it for the owner with the scope of their authority stated in the application.
What should I bring to a first meeting with an IP lawyer?
Bring the mark, invention or work itself, the dates it was first used, sold or disclosed, any filings in other countries, the contracts with whoever created it, and the owner's company documents. For a dispute, add evidence of the copying and any correspondence with the other side.
