Trademark registration in Bangkok: the offices involved

Trademark registration for a Bangkok business runs through the Department of Intellectual Property (DIP), and its registry is not in Bangkok itself. The office sits just across the city line at 563 Nonthaburi Road, Mueang Nonthaburi, with a 1368 hotline for general questions.

Few applicants ever go there. The DIP accepts trademark applications through its electronic filing system, e-Filing, and an owner can appoint an agent to file and correspond on their behalf. For most Bangkok clients, the firm is the point of contact with the registry.

Before filing, the DIP points applicants to its public search database and its bilingual list of goods and services by class, both described on its trademark registration conditions page. The same page sets a rule that often catches foreign brands: a mark containing foreign words must state its Thai reading and a Thai translation, and a Chinese mark must give Thai readings in both Mandarin and Teochew.

When a registered mark is copied, the case goes to court, and that court is in Bangkok. The Central Intellectual Property and International Trade Court sits in the Government Complex on Chaeng Watthana Road, Lak Si. Its jurisdiction covers civil and criminal trademark cases, and because no regional IP courts have been set up, it currently hears them from across the country.

How to compare the Bangkok firms listed here

Trademark work splits into four stages, and firms do not cover them all equally:

  • Search and clearance: checking the register for identical and similar marks before any official fee is paid.
  • Filing and prosecution: preparing the application, the Thai transliteration, and replies when the registrar raises an objection.
  • Opposition and appeals: opposing a conflicting mark, defending your own, and taking a refusal to the Trademark Board.
  • Enforcement: cease-and-desist work, raids on counterfeit stock, and litigation before the IP court.

Bangkok trademark firms range from intellectual property specialists to full-service practices where trademarks sit beside corporate and dispute work. Each card here shows the firm's languages, whether the first consultation is free, and an hourly rate where the firm publishes one. Open a profile to see which related services it lists, such as intellectual property disputes or licensing, before you shortlist.

Preparing for a first consultation

A firm can give a sharper answer when you bring the facts it will need to file. The DIP's list of supporting documents sets the baseline:

  • The mark itself: a clear image, sized to the 5 by 5 centimetre box on the application form.
  • The goods or services: what the mark is used on now and what it may cover later, so the firm can map them to classes.
  • Owner identity: a Thai ID card for an individual, or a passport for a foreign owner; for a company, a company certificate issued within six months of filing.
  • Agent appointment: a power of attorney naming the firm, with 30 baht of stamp duty per agent.
  • Earlier filings abroad: dates and numbers, because a priority claim uses its own form and supporting evidence.

Questions worth asking before you engage a firm:

  1. Which stages are in the quote: search, filing, office action replies, opposition?
  2. Who does the work, and who signs as agent with the DIP?
  3. Are fees fixed per stage or hourly, and are official fees billed separately?
  4. How will the Thai reading and translation of the mark be chosen?
  5. If a dispute starts, does the same team appear before the IP court?

The official fee schedule, the ten year term and the opposition window are set out on the Thailand-wide trademark registration page. For brands that also need patents or copyright, an intellectual property lawyer can cover all three.

Appeal deadlines to keep in view

The Trademark Act sets short windows once the registry has ruled. Under the Act, as translated on WIPO Lex, an applicant has sixty days from receiving a refusal to appeal to the Trademark Board. An applicant or opposer has the same sixty days to appeal an opposition decision, and ninety days from receiving the Board's decision on an opposition to take it to court. A firm handling the file should diarise these dates from the day the notice arrives.

This page is general information, not legal advice. For a specific mark or dispute, speak with a qualified professional.
