Working with a patent lawyer in Bangkok

A patent lawyer in Bangkok usually does three jobs: drafting the description and claims, filing and prosecuting the application with the Department of Intellectual Property (DIP), and acting if the patent is later opposed, challenged or copied. The firms listed above work from Bangkok. This page covers the local layer: which offices are involved, how to compare providers, and what to bring to a first meeting. For patent types, protection terms and PCT national phase entry, see the national guide to patent registration in Thailand.

Where patent matters are handled around Bangkok

The patent office. Thailand has one patent office, the DIP, and it sits just outside the capital, at 563 Nonthaburi 1 Road in Mueang Nonthaburi. Applications can be filed there on paper or through the DIP's e-filing system. For internet filings, the DIP's invention patent registration page says the applicant presents the application and supporting documents to the Department within 15 days of receiving the application number. In practice a registered agent handles filing and examination correspondence, so an inventor rarely needs to visit the office.

The court. Patent disputes go to the Central Intellectual Property and International Trade Court, on floors 5 to 7 of Building A at the Government Complex on Chaeng Watthana Road, Lak Si. The law gave it six provinces around Bangkok, but because no regional IP courts have been set up, its jurisdiction currently covers the entire Kingdom. It hears civil and criminal patent cases and disputes over technology transfer and licensing agreements. A civil plaintiff may also file at the provincial court where the defendant is domiciled or where the cause of action arose.

Foreign applicants, agents and Thai translations

An applicant who does not reside in Thailand must authorise a patent agent or patent attorney registered with the DIP's Director-General. A power of attorney signed abroad needs its signatures certified, for example by a Thai embassy or consulate or a notary public, and each power of attorney carries a revenue stamp of 30 baht per agent per application.

Documents in a foreign language go in with a Thai translation and the translator's certification. If the DIP finds a correctable defect, the applicant has 90 days from notification to fix it, or the application is treated as abandoned unless the Director-General extends the period. Official fees are modest: the DIP fee schedule lists 500 baht for an invention patent application and 250 baht for a design or petty patent application, with annual fees from the fifth year. Drafting, translation and prosecution are billed by the firm on top.

How to compare patent providers in Bangkok

The firms on this page are IP practices with patent work in scope, but the wider market mixes patent specialists with firms that mostly register trademarks. Patent quality depends on the claims, so ask who drafts them and in which technical fields that person has worked. If your concern is a brand name or logo rather than an invention, the trademark registration page is the better starting point.

A few comparison points matter more than size:

  • Technical fit. Ask whether the drafter has handled inventions like yours. The Patent Act lists computer programs among the things it does not protect, so software-related inventions need careful framing from someone who knows the examination practice.
  • Languages. Filings are in Thai, but reports, drafts and advice can be in English or another language. Each card shows the languages the firm works in.
  • Enforcement. If copying is a realistic risk, check whether the firm litigates before the IP court itself or refers cases out. The page on intellectual property lawyers in Bangkok covers enforcement and where IP disputes are heard.
  • First consultation. Each card shows whether the first consultation is free and how long it runs, and hourly rates where the firm publishes them.

Preparing for a first patent consultation

Bring what lets a lawyer judge novelty and ownership quickly:

  • A written description of the invention, with drawings, prototypes or photos
  • Dates of any public disclosure, sale, publication or exhibition, since disclosure before filing can destroy novelty
  • Earlier filings in other countries and their priority dates
  • Proof of who owns the invention: employment terms, contractor agreements or assignments
  • The markets where you plan to make or sell the product

Useful questions to ask: who drafts and who handles office actions, whether translation is done in-house, how fees are charged at each stage, and which language you will receive reports in.

This page is general information about patent services in Bangkok, not legal advice. For a specific invention, speak with a qualified patent professional.

Common questions

Frequently asked questions

Is the Thai patent office in Bangkok?
Not quite. The Department of Intellectual Property, which examines and grants Thai patents, is at 563 Nonthaburi 1 Road in Mueang Nonthaburi, just north of Bangkok. Most applicants never visit, because a registered agent files and corresponds with the office for them.
Can a Bangkok resident file a Thai patent without an agent?
The Department of Intellectual Property requires a registered patent agent or patent attorney when the applicant does not reside in Thailand. A resident is not caught by that rule, but most applicants still use a professional because the wording of the claims decides what the patent protects.
How much are the official Thai patent filing fees?
The Department of Intellectual Property fee schedule lists 500 baht for an invention patent application and 250 baht for a design patent or petty patent application, plus further fees for publication, examination, grant and annual fees from the fifth year. A firm's drafting, translation and prosecution fees are charged separately.
Where are patent infringement cases heard in Thailand?
At the Central Intellectual Property and International Trade Court, in the Government Complex on Chaeng Watthana Road in Lak Si, Bangkok. Its jurisdiction currently covers the entire Kingdom, and it hears both civil and criminal patent cases. A civil plaintiff may instead file at the provincial court where the defendant is domiciled or where the cause of action arose.
Can a power of attorney signed outside Thailand be used for a Thai patent?
Yes, if the signatures are certified, for example by a Thai embassy or consulate or a notary public in the country where it was signed. A Thai translation goes with a foreign-language power of attorney, and each one carries a 30 baht revenue stamp per agent per application.
