What a personal injury lawyer in Thailand handles

A personal injury lawyer in Thailand helps people who have been hurt through someone else's fault recover their losses: medical bills, lost income, and compensation for the injury itself. Most of the work happens with insurers, employers and the other side's lawyers. Court is the last step, not the first.

The matters that come up most often:

  • Road accidents, including motorbike and pedestrian injuries.
  • Injuries at work, where the employer's compensation fund pays first.
  • Injuries from a faulty product, where the maker or importer can be liable without proof of negligence.
  • Falls on someone else's premises, such as a hotel, shop or building site.
  • Insurance refusals or low offers after any of the above.

Injuries from medical treatment fall under medical malpractice, a separate specialism. Each firm's profile shows where it is based and the languages it works in, which matters if you are searching for a lawyer near you after an accident away from home.

Money you can claim before any lawsuit

Several schemes pay without anyone going to court. A lawyer usually starts by making sure these are claimed in time.

Road accidents. Every vehicle must carry compulsory motor insurance, known in Thai as Por Ror Bor. Under the current compulsory policy terms, the insurer pays initial compensation within 7 days without waiting for proof of fault: up to 30,000 baht for medical costs, 35,000 baht for death or listed permanent injuries, and 65,000 baht combined. The request must reach the insurer within 180 days. Once liability is established, the policy covers up to 80,000 baht for injury and 500,000 baht for death or total permanent disability. A driver hurt in their own insured vehicle receives initial compensation only.

These payments do not end the matter. The motor accident victims law keeps the right to claim more from whoever caused the accident, and a fund pays where the vehicle was uninsured or the driver fled.

Work injuries. The employer reports the injury to the Social Security Office within 15 days, and the employee can also file a claim within 180 days. The Workmen's Compensation Fund pays medical costs from a 65,000 baht base, rising in tiers up to 1,000,000 baht for serious injuries, and 70% of the monthly wage while the employee cannot work, subject to a cap.

Injuries caused by a crime. A person harmed by an offence such as assault can apply for state compensation within one year of learning of the offence, through the Ministry of Justice, whether or not the offender pays.

Deadlines that decide claims

The general deadline for an injury claim is short. Under the Civil and Commercial Code, a claim for a wrongful act expires one year from the day the injured person knew of the act and who is liable, and never later than ten years after the act. Where the act is also a crime with a longer limitation period, the longer period applies.

Product injuries run on a different clock. Under the unsafe goods law, a claim must be brought within three years of learning of the damage and the liable business, and within ten years of the sale. A lawyer can check whether a deadline has already started running, which is often the most valuable thing a first consultation does.

How a personal injury claim usually runs

  1. Treatment and records. Get treated, and keep every receipt and medical report.
  2. Report the incident. Motor insurers and the crime-victim scheme ask for a copy of the police daily log, and the work-injury fund asks for one after a road accident away from the workplace. Tourists can call the Tourist Police on 1155, which runs 24 hours a day with multilingual help.
  3. Claim the no-fault money. Compulsory motor insurance, the Workmen's Compensation Fund, or your own policies, each with its own deadline.
  4. Demand and negotiation. The lawyer values the full loss and puts it to the insurer or the party at fault.
  5. Mediation. Before filing, a party can ask the court to appoint a mediator. There is no court fee, and if mediation fails, the limitation period is extended by 60 days.
  6. Court. A civil claim for compensation, or a claim inside a criminal case.

The criminal route matters in road accidents and assaults. When the public prosecutor charges the person who caused the injury, the injured person can ask the criminal court to order compensation in the same case, with no court fee, but must do so before the witness hearings begin. The injured person can also join the prosecution as a co-plaintiff at any stage before the first-instance judgment. Product injury claims are consumer cases, which can be filed orally and are generally exempt from court fees.

Compensation can cover medical costs, lost earnings and lost earning capacity, funeral costs and the support dependants lose after a death, and non-financial harm. It can be reduced where the injured person was partly at fault.

Evidence to gather

  • Medical reports, hospital bills and receipts, from the first treatment onward
  • The police daily log and any case number
  • Photos and video of the scene, the vehicles or the product, and your injuries
  • Names and contact details of witnesses and of the other party, and their insurer
  • For a road accident, the vehicle registration numbers and insurance details
  • For a work injury, your employment contract, payslips and any form the employer filed
  • For a product injury, the product itself, its packaging and the proof of purchase
  • Records of lost income, such as payslips, invoices or a letter from your employer

Choosing a personal injury lawyer

Only a lawyer registered and licensed with the Lawyers Council of Thailand may plead in court or draft court filings for someone else, and registration requires Thai nationality. Ask for the name and licence number of the lawyer who will handle your file.

Then compare firms on practical points:

  • Claim type. Has the firm handled motor insurance, work-injury or product claims like yours?
  • Who does the work. Who talks to the insurer, and who would appear in court?
  • Language. Medical reports and court papers are often in Thai. Each card shows the languages the firm works in.
  • Location. A court hearing is held where the case is filed, so ask how the firm handles hearings outside its home city.

Fee and insurance questions to ask

Lawyers in Thailand may not advertise their fee rates or offer to act for no fee outside legal aid, so fee terms come up in the first consultation. Ask whether the fee is fixed, hourly or linked to the amount recovered, what happens to the fee if the claim settles early, and whether court fees, medical assessments and translations are billed separately. Get the agreement in writing.

Ask about insurance too. Your own travel, health or motor policy may already cover medical costs or legal expenses, and a lawyer needs those policy details to avoid claiming the same loss twice.

If cost is a barrier, a party who cannot pay can apply to the court for an exemption from court fees. The Ministry of Justice's Justice Fund can help with lawyer and court fees after assessing the applicant's circumstances, and the Lawyers Council runs free legal consultation every day on hotline 1167. Eligibility can depend on the applicant, so check before relying on either.

Common questions

Frequently asked questions

What does a personal injury lawyer in Thailand do?
A personal injury lawyer claims compensation for someone hurt through another person's fault. The work usually starts with the no-fault schemes, such as compulsory motor insurance or the Workmen's Compensation Fund, then values the full loss, negotiates with insurers and the party at fault, and if needed takes a civil claim to court or claims compensation inside a criminal case.
How long do I have to file a personal injury claim in Thailand?
Under the Civil and Commercial Code, a claim for a wrongful act expires one year from the day the injured person knew of the act and who is liable, and in any case ten years after the act. A longer period can apply if the act is also a crime. Claims for injuries from unsafe products have three years from learning of the damage and the liable business, and ten years from the sale.
Will I get anything from insurance if I was hurt in a road accident?
Yes, usually. Every vehicle must carry compulsory Por Ror Bor insurance, which pays initial compensation within 7 days without waiting for proof of fault: up to 30,000 baht for medical costs, 35,000 baht for death or listed permanent injuries, and 65,000 baht combined. The request must reach the insurer within 180 days, and the payment does not stop a further claim against whoever caused the accident.
What compensation can I claim for an injury?
Thai law allows compensation for medical costs, lost earnings and lost earning capacity, funeral costs and the support dependants lose after a death, and non-financial harm. The amount can be reduced if the injured person was partly at fault. A lawyer values each item against your records before negotiating.
How much does a personal injury lawyer cost in Thailand?
Each firm sets its own fees, and lawyers may not advertise fee rates or offer to act for no fee outside legal aid, so terms are agreed in the first consultation. Ask whether the fee is fixed, hourly or linked to the amount recovered, and get it in writing. Court fees can be waived for a party who cannot pay, product injury cases are generally exempt, and the Justice Fund can help with lawyer and court fees after an assessment.
I was injured as a tourist in Thailand. Where do I start?
Get treatment and keep every receipt and report, then report the incident to the police so there is a daily log. The Tourist Police hotline 1155 runs 24 hours a day with multilingual help. Check your travel insurance, claim compulsory motor insurance within 180 days if a vehicle was involved, and speak with a lawyer early, because the general deadline to sue is one year from knowing who is liable.
