Bringing or defending a civil claim in Thailand: what the courts decide, how proceedings run in Thai, and how a judgment is enforced afterwards.

The civil courts decide private disputes about money and rights: unpaid debts, breaches of agreement, property claims, and compensation. Specialised courts sit alongside them for particular subjects, including labour, intellectual property and international trade, and tax, so part of the initial assessment is simply which forum a claim belongs in.
Proceedings run in Thai. Documents in another language are filed with translations, and a foreign party appears through Thai counsel. That is not a formality: it shapes the timetable and the cost, and it means the quality of translation for key documents can matter as much as the argument built on them.
A civil judgment establishes the entitlement. Turning it into money is a separate stage with its own machinery, which is where a substantial share of unsuccessful claims actually fail.
Note: Winning and collecting are different stages
Where a losing party does not pay voluntarily, the court issues a writ of execution appointing an executing officer, who can seize property, attach claims owed to the debtor, or use other measures under the Civil Procedure Code. A judgment can be enforced for ten years. This is why an honest assessment of what the other side owns belongs at the start of a case rather than the end.

The work divides into assessment, preparation, and conduct. Assessment establishes whether the claim is within its time limit, which court hears it, and what can realistically be recovered. Preparation assembles the documentary record, since Thai civil proceedings lean heavily on documents, and arranges certified translations where needed.
Conduct covers pleadings, hearings, and the judgment, then enforcement if payment does not follow. Court fees are calculated on the value of the claim rather than charged at a flat rate, so the filing cost scales with the amount claimed and a firm confirms it for a specific case. Professional fees are separate and set by each firm.
Most disputes are still better settled than tried, and a well-prepared case improves settlement terms rather than only preparing for a hearing. Related routes cover debt collection where the sum is not genuinely disputed and contract disputes where the disagreement is about the agreement itself. Firms handling civil proceedings sit under litigation and dispute resolution.
This page is general information, not legal advice. Time limits and procedures vary by claim; for a specific matter, speak with a qualified professional.
