Key facts

Can we divorce without going to court?
No. Every divorce in Hong Kong is granted by the Family Court. A joint application or an undefended petition goes on the Special Procedure List, where neither spouse has to attend the hearing.
How soon after marrying can I file?
After one year of marriage. The court allows an earlier petition only in cases of exceptional hardship or exceptional depravity.
When does the divorce become final?
Six weeks after the decree nisi, either spouse can apply for the decree absolute. Where there are children, it is not made absolute until the court is satisfied with the arrangements for them.
Can we divorce here if we married abroad?
Usually yes, if either spouse is domiciled in Hong Kong, has lived here habitually for the three years before filing, or has a substantial connection with Hong Kong.

What a divorce lawyer in Hong Kong actually does

A divorce lawyer in Hong Kong works inside one system: the Family Court. There is no registry or administrative divorce here, so every marriage that ends, however amicably, ends with a court decree. What a lawyer changes is how much of that process you carry yourself, and how the money and the children are settled alongside it.

The law is the Matrimonial Causes Ordinance. There is one ground for divorce, that the marriage has irretrievably broken down, and it has to be supported by one of five facts: adultery, unreasonable behaviour, desertion for one year, one year's separation with your spouse's consent, or two years' separation without it.

Couples who agree can file a joint application instead. It rests on either one year's separation or a notice both spouses gave the court at least a year earlier, and during that notice year you do not have to live apart.

One timing rule catches people early. Unless the court allows otherwise, no petition can be filed until the marriage is at least one year old, and the exception is reserved for exceptional hardship or depravity.

When you need a divorce lawyer, and when you might not

The Judiciary's own guidance says you will particularly need a lawyer when your spouse does not agree to a divorce, or when the two of you cannot agree on the children or on money.

An uncontested case is mostly paperwork. A joint application, or a petition the other side does not answer, goes on the Special Procedure List, and neither party has to attend the hearing. The court grants a decree nisi, and six weeks later you can apply for the decree absolute that ends the marriage. The forms can be completed in English or Chinese, and some couples file them without a lawyer.

The money side is called ancillary relief: maintenance, transfer of property, and division of matrimonial assets. You ask for it in the petition or joint application. Contested claims normally go to a Financial Dispute Resolution hearing, where a judge helps both sides negotiate on a privileged basis, meaning nothing said there can be used as evidence later, and that judge does not hear the trial if talks fail.

Disputes over children run on a parallel track called Children's Dispute Resolution, where the children's best interests are the court's paramount concern. If the family home has to be transferred once an order is made, a property lawyer in Hong Kong usually handles the conveyancing.

How to choose a family law firm

Do they run contested financial cases? Many firms file uncontested petitions. Fewer take a case through financial disclosure, valuations and a full hearing. Ask how often they go past the Financial Dispute Resolution stage.

Who will argue in court? Hong Kong has a split profession. Solicitors run the file and deal with you day to day. Barristers are specialist advocates, and in most situations you cannot instruct one directly: your solicitor briefs them. Ask whether the firm expects to brief a barrister, and at what stage.

Which language will the case run in? Family Court forms can be completed in English or Chinese. If you and your spouse work in different languages, ask who at the firm covers each.

What is fixed and what is hourly? A joint application with an agreed settlement is often quoted as a fixed fee. A contested money or children case is almost always billed by time, because nobody knows at the start how long the other side will resist.

Cross-border families and marriages registered abroad

The Hong Kong court's jurisdiction turns on each spouse's connection to Hong Kong. Either spouse must be domiciled here, have been habitually resident here for the three years before filing, or have a substantial connection with Hong Kong. A couple who married in London or Sydney can often divorce here, and a lawyer can check whether the decree will be recognised in the other countries that matter to you.

Mainland China has its own arrangement. Since 15 February 2022, courts in Hong Kong and the Mainland can recognise and enforce each other's judgments in covered matrimonial and family cases, and the scheme also covers Mainland divorce certificates issued from that date.

Children raise the stakes. Hong Kong implements the Hague Convention on the Civil Aspects of International Child Abduction through the Child Abduction and Custody Ordinance, with the Secretary for Justice acting as Central Authority, so a child wrongfully removed from or kept outside Hong Kong can be the subject of a return application. A lawyer can explain where the line sits before anyone books a flight.

If your permission to stay in Hong Kong depends on your marriage, ask an immigration lawyer how a separation affects it before you file.

What it costs, in context

The court fees are modest. Filing a petition or joint application costs HK$630, and setting the case down costs HK$630 on the Special Procedure List or HK$1,045 on the Defended List. The Judiciary's Performance Pledge aims for 50 days from setting down to decree nisi on the Special Procedure List, and 110 to 140 days from setting down to a one-day hearing for financial applications.

Legal Aid can fund a family case for people who pass the means and merits tests, and the Duty Lawyer Service's Free Legal Advice Scheme offers preliminary advice on matrimonial law at District Offices.

Firms listed on Justenda set their own fees. Ask what a quote covers, whether barrister's fees sit inside it, and what changes the price if the other side contests. A divorce is also a natural moment to review a will, and an estate planning and probate lawyer can check what needs to change. This page is general information, not legal advice. Common questions

Frequently asked questions

How long does a divorce take in Hong Kong?
For an uncontested case, the Judiciary's Performance Pledge aims for about 50 days from setting the case down to the decree nisi on the Special Procedure List. The decree absolute can be applied for six weeks after the decree nisi. Contested cases take longer: the pledge for the Defended List is 110 days to the decree nisi hearing, and financial applications aim for 110 to 140 days from setting down to a one-day hearing. Preparing the papers and any financial disclosure adds time before those clocks start.
Can foreigners get divorced in Hong Kong?
Yes, where the Hong Kong court has jurisdiction. Either spouse must be domiciled in Hong Kong, have been habitually resident in Hong Kong for the three years before filing, or have a substantial connection with Hong Kong. Whether the divorce is then recognised in another country is a separate question that a lawyer can check against that country's rules.
How is child custody decided in Hong Kong?
When parents divorce, the petition or joint application must set out proposals for the custody of, and access to, any children under 18. Where parents disagree, the Family Court uses its Children's Dispute Resolution procedure, and the children's best interests are its paramount concern. The court can order a social investigation report, and the decree absolute is not granted until the court is satisfied with the arrangements for the children.
Do I need a lawyer to get divorced in Hong Kong?
Not always. Divorce forms can be filed in English or Chinese without a lawyer, and joint applications on the Special Procedure List need no attendance at the hearing. The Judiciary says a lawyer is particularly needed when one spouse does not agree to the divorce, or when the spouses cannot agree on the children or on money. Legal Aid is available to people who pass the means and merits tests.
What is a Financial Dispute Resolution hearing?
It is a Family Court hearing in a contested money claim on divorce, where a judge helps both spouses try to reach a settlement. What is said at the hearing cannot be used as evidence later, and the judge who conducts it does not hear the case if it goes to trial. Before it, both spouses file and exchange a financial statement setting out their means.
